    Abu Dhabi Labour Court of First Instance has obliged a company to pay Dhs13,304 to an employee who had been working for it for about 9 years, but the company arbitrarily dismissed her without paying her dues, which include the warning allowance, late wages, and salary deductions.

    In the details, an employee filed a lawsuit against the company she was working for, after she resorted to the Ministry of Human Resources and Emiratisation (MoHRE) Committee, requesting that the company be obligated to pay her Dhs5,000 as a monthly salary, Dhs500 deducted from the salary with a total of Dhs4,000, an arbitrary dismissal allowance of Dhs15,000, a warning allowance of Dhs5,000, an end of service gratuity of Dhs20,000, a profit and commission allowance of Dhs40,000, a compensation for material and moral damages of Dhs5,000, legal interest of 12% from the date of the claim until full payment and fees, expenses and lawyer’ fees.

    The employee said that she worked for the company with a basic salary of Dhs1,500 and a total of Dhs5,000 and that she was dismissed without receiving her dues.

    The court explained that the lawsuit papers are free of evidence that the company already paid the appellant her financial dues and therefore the employee was right in her claim for her late salary of Dhs4,167, a deductions of Dhs4,000, and a warning allowance Dhs5,000.
